Alternative Dispute Resolution (ADR)

The principal attorney at David F. Zuppke, PLC, is fully trained and accredited by the American Arbitration Association.  He is approved to sit as a Neutral Arbitrator in both Commercial and Employment matters.

 

Mr. Zuppke has substantial experience as an AAA assigned arbitrator as well as a privately retained arbitrator in disputes involving employment disputes, commercial disputes, negligence claims and a host of other contract and tort claims.

 

He has proudly served the Wayne County and Oakland County Courts in mediations, case evaluations and facilitation matters.  In his 30 years of practice, he has been involved in hundreds of such ADR matters.

 

Having been selected by numerous law firms, private individuals and the courts, he has earned a reputation for delivering unbiased and fair decisions in arbitration disputes and as an effective mediator and facilitator.

 

In 2006, he was invited by the Michigan Trial Lawyers Association Employment section to speak on the subject of Arbitration at the annual meeting.

Confidentiality is guaranteed in every ADR process unless the parties agree, in writing, otherwise.

Advantages of ADR

 

All ADR processes have advantages and disadvantages. Generally speaking, resolving disputes through one of the ADR processes saves money and time.  Because it is voluntary and confidential the parties can usually set their own rules and better protect proprietary and private matters.

 

ADR is far less formal than the court system and the parties need not rely on an arbitrarily assigned judge or jury.  By voluntarily selecting ADR as your method of resolution, you can insure that the person hearing your case is knowledgeable in the area of concern, i.e. an expert.  ADR allows the parties to control the forum.

Fees:

 

Our fees for ADR matters are designed to be flexible and will be tailored to fit your needs.  In uncomplicated matters involving claims of less value, our fees generally start at $150.00 per hour with a minimum of 3 hours, (not including travel time if the location is outside of a 50 mile radius).

 

In more complicated and higher value cases, our hourly fees are somewhat higher. If requested, we will offer a flat rate "per day" fee, (not including study time).
